1. Definitions and Interpretation
In these Terms and Conditions:
- "Company" means Akshar Productions (Registered No. 16932531), whose operations focus on AV equipment hire and event production.
- "Client" or "Hirer" means the person, firm, or organisation hiring equipment or purchasing services from the Company.
- "Equipment" means all audio-visual, lighting, staging, and related accessories supplied by the Company.
- "Services" means technical support, event production, installation, and operation provided by the Company.
- "Hire Period" means the period commencing when the Equipment leaves the Company's premises and terminating when it is returned.
2. Quotes and Booking
2.1 All quotations provided by the Company are valid for 14 days from the date of issue unless otherwise stated.
2.2 A booking is only confirmed once the Company receives written acceptance of the quote and any required deposit has been paid in cleared funds.
2.3 The Company reserves the right to substitute quoted Equipment with similar items of equal or superior specification should the original items become unavailable.
3. Payment Terms
3.1 Invoices are payable within the terms stated on the invoice. For new clients, full payment or a substantial deposit is typically required prior to the event date.
3.2 Late payments may accrue interest under the Late Payment of Commercial Debts (Interest) Act 1998.
3.3 All prices quoted are subject to Value Added Tax (VAT) at the prevailing rate where applicable.
4. Cancellations
In the event of cancellation by the Client, the following charges will apply:
- More than 30 days prior to the event date: Loss of initial deposit (if applicable) or 10% of total fee.
- 14 to 30 days prior to the event date: 50% of the total agreed fee.
- Less than 14 days prior to the event date: 100% of the total agreed fee.
5. Hirer's Responsibilities and Insurance
5.1 The Hirer assumes full responsibility for the Equipment from the time of delivery or collection until it is returned to the Company.
5.2 The Hirer must ensure that adequate insurance cover is in place for the full replacement value of the Equipment against loss, theft, damage, or destruction during the Hire Period.
5.3 The equipment must not be moved from the agreed delivery/event location without the Company's prior written consent.
5.4 The Hirer is responsible for ensuring the venue provides sufficient safe power supplies and suitable access for loading/unloading.
6. Liability
6.1 The Company shall not be liable for any consequential losses, loss of profit, or damage to property arising from the use or failure of the Equipment or Services.
6.2 In the unlikely event of equipment failure, the Company will use reasonable endeavours to repair or replace the faulty item as swiftly as possible. The Company's liability is strictly limited to the proportional hire cost of the failed item.
7. Health and Safety
The Company complies with current Health and Safety legislation. The Client must not interfere with the Equipment's safe operation and must comply with any safety instructions given by the Company's technicians.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the English courts.
